Arkansas Life, Accident & Health exam — Group Health Insurance.

Group health basics (master policy and certificates, contributory and noncontributory plans, coordination of benefits, federal COBRA for employers with 20 or more employees) are in the national guide. The Arkansas-specific topic is state continuation of group health coverage under Ark. Code 23-86-114, which the Arkansas Health exam tests in detail.

Arkansas state continuation (23-86-114)

Rule Arkansas requirement
Eligibility Insured under the group policy continuously for at least three months before employment or membership ended
Election Requested in writing no later than 10 days after termination
Maximum length Ends no later than 120 days after continuation began
Earlier end Nonpayment of premium, Medicare eligibility, or termination of the group policy
Benefits not required Dental, vision, and prescription drug coverage
Plans not subject Self-insured employer plans

State continuation is much shorter than federal COBRA. It is a separate right for employees whose plans fall under the state law.

Group life (related rules)

Under Arkansas group life law:

  • A person leaving employment may convert to an individual policy without evidence of insurability by applying and paying the first premium within 31 days (23-83-117).
  • The converted amount can't exceed the group coverage that ended. The premium is based on attained age and current risk class.
  • If notice of the conversion right isn't given at least 15 days before the period expires, the person gets an additional period to convert (23-83-122).
  • Death during the conversion period is paid as a group claim (23-83-119).
  • A group life policy may let the insurer pay up to $10,000 of the benefit to a person who paid funeral or last-illness expenses (23-83-115).

Common exam traps

  • State continuation: 3 months of prior coverage, 10 days to elect, 120 days maximum.
  • Dental, vision, and prescription drugs need not be continued.
  • Self-insured plans aren't subject to the state continuation law.
