Free Annuities Study Guide
Iowa Life exam — Annuities.
The national guide explains how annuities work:
- phases: accumulation and payout;
- types: fixed, variable and indexed; immediate and deferred;
- payout options, surrender charges and 1035 exchanges.
Iowa's state questions on annuities focus on the annuity best interest rule (191 IAC 15.72–15.78), the training required to sell annuities and indexed products, and the free-look and replacement rules.
National concepts in brief
- The annuitant is the measuring life; the owner controls the contract.
- Fixed annuities guarantee a minimum rate. Variable annuities put the investment risk on the owner. Fixed indexed annuities credit interest tied to a market index, subject to caps.
- Surrender charges apply to early withdrawals. A 1035 exchange defers tax when one contract is swapped for another.
The best interest rule
Scope (191 IAC 15.73):
- It applies to annuity sales and recommendations made on or after January 1, 2021.
- It does not apply to direct-response sales with no recommendation, certain employer plans, structured settlements, or annuities that fund formal prepaid funeral contracts.
The four obligations. A producer acts in the consumer's best interest by meeting four obligations (191 IAC 15.75):
- Care. Know the consumer's financial situation, insurance needs and goals. Have a reasonable basis for the recommendation.
- Disclosure. Before the recommendation or sale, disclose on a form like the model's Appendix:
- the producer's role;
- the products the producer is licensed and authorized to sell;
- how the producer is paid.
- Conflict of interest. Identify and avoid material conflicts, or reasonably manage and disclose them.
- Documentation. Record the recommendation and its basis in writing.
What the rule does not do:
- It creates a regulatory obligation, not a fiduciary one.
- It does not require recommending the lowest-commission annuity.
- It does not create a duty to monitor the contract afterward.
- A fixed annuity sale needs only a producer license with the right line, unless the producer also gives securities advice.
Exchanges and replacements. The producer must consider:
- surrender charges and benefits lost;
- whether the consumer benefits;
- whether the consumer has had another exchange or replacement in the past 60 months.
Records: insurers and producers keep the consumer information and recommendation records for 10 years after the transaction is completed (191 IAC 15.78). That is much longer than the three-year general producer record rule.
Training requirements
- Annuities: a one-time 4-credit annuity training course approved by the commissioner, completed before selling annuities (191 IAC 15.76). The course may not include marketing, sales techniques or one insurer's products. The insurer must verify completion before letting the producer sell its annuities.
- Indexed products: a separate 4-credit indexed products course before advising on or selling fixed indexed annuities or fixed indexed life (191 IAC 15.81–15.82). Those credits count toward CE (191 IAC 15.83).
Free look and replacement
- Free look: an individual annuity that doesn't replace other coverage may be returned within 10 days of receipt for a refund (191 IAC 15.9).
- Replacement (191 IAC chapter 16):
- The producer presents and reads the replacement notice no later than when the application is taken, and leaves copies of the sales material used.
- The replacing insurer notifies the existing insurer within 5 business days.
- The owner gets a 30-day right to return the new contract.
- Financed purchase: using values from an existing contract 4 months before to 13 months after the new contract's effective date is presumed to be one (191 IAC 16.22).
Other related rules
- Annuity suitability statute: a recommendation needs reasonable grounds, based on a reasonable inquiry into the buyer's financial status and investment objectives (Iowa Code 507B.4B).
- Guaranty association: the Iowa Life and Health Insurance Guaranty Association protects annuity benefits up to $250,000 in present value (Iowa Code 508C.3). Producers may not use it as a sales tool.
- Senior designations: self-conferred or misleading senior designations are prohibited (191 IAC 10.19(4)).
- Unclaimed benefits: insurers compare annuities and policies against the death master file at least semiannually (Iowa Code 507B.4C).
Common exam traps
- Best interest = care, disclosure, conflict of interest, documentation. It is not a fiduciary standard.
- Annuity records are kept 10 years.
- Two separate 4-credit courses: one for annuities, one for indexed products. Only the indexed course credits are stated to count toward CE.
- Disclosure comes before the recommendation.
- The annuity free look is 10 days, or 30 days on a replacement.
