Free Annuities Study Guide

Michigan Life exam — Annuities.

The national Annuities guide explains how annuities work: accumulation and payout, fixed, indexed and variable contracts, and taxation. This guide covers Michigan's rules for selling them. The main ones are the best interest standard added to the Insurance Code in 2020 (MCL 500.4151–4165) and the annuity free look.

Best interest standard (MCL 500.4155)

When a producer recommends an annuity, the producer must act in the consumer's best interest. The producer may not put his or her own financial interest, or the insurer's, ahead of the consumer's. The standard has four parts:

Obligation What it requires
Care Know the consumer's profile, understand the options and have a reasonable basis for the recommendation. For an exchange or replacement, consider surrender charges, lost benefits and any other exchanges or replacements, particularly within the preceding 60 months.
Disclosure Before the recommendation, give the consumer the Director's form. It describes the relationship, the products the producer is licensed to sell, the insurers represented and the sources of compensation. On request, the producer gives a reasonable estimate of cash compensation, which may be a range, and says whether it is one-time or recurring.
Conflict of interest Identify and avoid, or reasonably manage and disclose, material conflicts of interest
Documentation Record the basis of the recommendation

What the care obligation does not do:

  • It doesn't require recommending the annuity with the lowest compensation.
  • It doesn't create an ongoing monitoring duty, unless a separate advisory or planning agreement creates one.

Related rules:

  • No one may dissuade a consumer from truthfully answering profile questions, filing a complaint or cooperating with an investigation (4159).
  • The consumer gets a copy of the contract within a reasonable time after it's issued (4161).
  • Records of consumer information used in recommendations are kept 5 years after the transaction (4163).
  • The rules don't apply to contracts funding ERISA plans and certain other employer, government and church plans (4153).

Training (MCL 500.4160)

  • Before selling annuities, a producer completes a one-time 4-hour annuity training course from a registered provider.
  • The insurer must verify completion, for example through certificates or approved database reports.

Licensing

Selling variable annuities requires Michigan's separate variable life and variable annuity line of authority, plus securities registration (MCL 500.1206(1)(e)).

Free look (MCL 500.4073)

  • An annuity contract must carry a front-page notice of the right to cancel within at least 10 days after receipt. A returned contract is void from the beginning.
  • For a variable annuity, the refund is the unallocated premium plus the value of the separate account amounts on the day the insurer receives the returned contract.

Guaranty protection

The Michigan Life and Health Insurance Guaranty Association covers up to $250,000 in annuity present value, including cash surrender and withdrawal values (MCL 500.7704). Misrepresenting guaranty coverage is an unfair practice (2005(i)).

Common exam traps

  • Best interest: care, disclosure, conflict of interest, documentation. It is not a lowest-cost requirement or a monitoring duty.
  • Training: 4 hours, once. The insurer verifies it.
  • Records: 5 years. Replacement look-back: 60 months.
  • Annuity free look: 10 days, void from the beginning. A variable annuity refund includes the account value.
  • Guaranty limit: $250,000.
