Free Annuities Study Guide
Minnesota Life exam — Annuities.
The national Annuities guide covers annuity types, phases, payout options and taxation, including section 1035 exchanges. This guide covers Minnesota's annuity sales law: the best interest standard (Minn. Stat. 72A.2031–72A.2035) and the training requirement.
Best interest standard (72A.2032)
A producer recommending an annuity must act in the consumer's best interest and not put the producer's or insurer's financial interest first. The producer meets the standard by satisfying four obligations:
| Obligation | What it requires |
|---|---|
| Care | Know the consumer's profile and have a reasonable basis for the recommendation. The profile includes age, income, liquidity needs, risk tolerance, tax status and whether the consumer has a reverse mortgage (72A.2031). Consider any exchange or replacement in the last 60 months. |
| Disclosure | On the Commissioner's form, disclose the relationship, the products authorized, the insurers represented and how the producer is paid |
| Conflict of interest | Identify and avoid, or manage and disclose, material conflicts. Receiving compensation is not by itself a material conflict. |
| Documentation | Record the basis for the recommendation |
What the care obligation does not do:
- It doesn't create a fiduciary obligation.
- It doesn't require the lowest-compensation product.
- It doesn't impose ongoing monitoring, unless a separate fiduciary, advisory or planning agreement does.
Minnesota's extra senior protection: a replacement for a consumer 65 or older may not be recommended unless it gives a substantial financial benefit over the life of the annuity (72A.2032, subd. 1b(k)).
Insurer responsibility and records
- The insurer is responsible for compliance, whether a violation comes from its own action or its producer's (72A.2034).
- Records are kept 10 years after the transaction (72A.2035).
Training (72A.2033)
- A one-time 4-credit course approved by the Commissioner, titled "Best Interest Standards of Conduct for Annuity Sales," before selling annuities.
- The course covers recognizing signs that a buyer may lack the short-term memory or judgment to make a knowing purchase.
- The insurer verifies completion before the producer sells its products.
Other rules
- Using a nonexistent or self-conferred senior-specific designation to sell annuities is an unfair practice (72A.204).
- Unfair discrimination in annuity rates between people of the same class and equal expectation of life is prohibited (72A.20, subd. 8).
- Guaranty protection: up to $250,000 in annuity present value, including cash surrender and withdrawal values (61B.19).
Common exam traps
- Best interest = care, disclosure, conflict of interest, documentation. It is not a fiduciary duty.
- Buyers 65+: a replacement needs a substantial financial benefit.
- Records: 10 years. That's longer than many states.
- Training: 4 credits once, with the required course title. The insurer verifies it.
- Guaranty limit: $250,000.
