Utah Life, Accident & Health exam — Group Health Insurance.

Federal COBRA, HIPAA and the ACA are covered in the national Group Health Insurance guide. Utah adds a state continuation law, often called mini-COBRA (31A-22-722). It also has its own small-employer definitions and group policy rules. This guide covers those.

Group policy rules

  • Group formation: a group must be formed and kept in good faith for a purpose other than obtaining insurance (31A-22-701).
  • Grace period: at least 30 days, and the policy stays in force during it (31A-22-607).
  • Termination notice: the policyholder must notify each member 30 days before the group policy ends, along with continuation rights (31A-22-716).
  • Unpaid premium: an insurer can end its liability by notice. It can't notify certificate holders until 20 days after the premium is due and unpaid (31A-23a-410).
  • Wellness discounts to employer groups can't exceed 20% of premium and must be offered uniformly (31A-23a-402.5).
  • Former spouses: coverage ends only on a divorce, separation or annulment decree. A former spouse who applies within 30 days of notice gets individual coverage without proof of insurability (31A-22-612).

Small employers (31A-1-301)

  • Small employer: had at least 1 and no more than 50 eligible employees in the prior calendar year.
  • Eligible employee: works full time, with a normal week of 30 hours or more.
  • Small-employer plans use a uniform application with no health history questions (31A-22-635).

Common exam traps

  • Mini-COBRA: 12 months at 102%. It requires 3 months of prior coverage and isn't available to anyone eligible for federal COBRA.
  • The employer notice is due within 30 days. The election is due within 60 days.
  • Group grace period: 30 days, with the policy in force.
  • A Utah small employer has 1–50 eligible employees.
