What it does
CA 04 65 provides expense coverage when a covered auto's systems are hacked or otherwise compromised. ISO introduced it as Auto Hacking Expense Coverage in its 2022 revision (09 22 edition, effective September 1, 2022 in most states) and revised it in 01 24. In the 2026 multistate revision the 09 27 edition is retitled Cyber Incident Expense Coverage, approved for policies effective on or after September 1, 2027 in states that adopt it. State versions exist for Texas, Wisconsin, Alaska and Illinois.
Who needs it
Fleets with connected vehicles, telematics, keyless entry and over-the-air software updates, where an attack could disable vehicles or require reprogramming.
Key points
- It is first-party expense coverage, not liability for data breaches. Data privacy liability is excluded from covered autos liability by CA 05 38 where attached and belongs on a cyber policy.
- Read the schedule for limits, sublimits and deductibles.
Quoting notes
Ask how many vehicles are connected and which telematics platforms are used, and whether the client's cyber policy covers vehicle systems.
