Free Annuities Study Guide

Pennsylvania Life exam — Annuities.

Pennsylvania annuity questions focus on four topics:

  • The best interest standard in the Insurance Company Law (Article IV-B, as amended by Act 99 of 2021).
  • The one-time annuity training requirement.
  • The annuity free look in 40 P.S. 510d.
  • Guaranty association limits.

How annuities work (types, accumulation and payout, riders, taxation) is in the national Annuities guide.

Best interest standard (Insurance Company Law 403-B, Act 99 of 2021)

  • Pennsylvania uses a best interest standard for annuity recommendations, not the older suitability standard.
  • When recommending an annuity, the producer must act in the consumer's best interest and not put the producer's own interest first.
  • The producer meets this by satisfying four obligations: care, disclosure, conflict of interest and documentation.

Training (Insurance Company Law 403.1-B)

  • Before selling annuities, a producer completes a one-time 4-hour annuity training course.

Free look (40 P.S. 510d)

Annuities follow the same pattern as life insurance:

Situation Minimum free look
Not a replacement 10 days
Replaces an annuity from a different insurer 20 days
Replaces one from the same insurer or group 45 days
  • The contract must include a right-to-examine provision letting the owner return it within the stated period for a refund.

Replacement and disclosure

  • Replacement: replacing an annuity is covered by 31 Pa. Code Chapter 81. The producer presents the signed Notice Regarding Replacement, and the replacing insurer notifies the existing insurer within 5 working days.
  • Disclosure: annuities are exempt from the life insurance disclosure regulation (31 Pa. Code Ch. 83). Pennsylvania has no annuity buyer's-guide regulation.

Bank sales (40 P.S. 310.77)

  • An annuity sold on bank premises requires a written disclosure that it is not a deposit, not FDIC-insured, not guaranteed by the bank and may lose value.
  • The sale must take place in an area separate from deposit-taking.

Guaranty protection

  • The Pennsylvania Life and Health Insurance Guaranty Association covers the present value of annuity benefits up to $250,000 for one life (40 P.S. 991.1703).
  • No one may use the Association's existence in a sales solicitation (991.1717(a)).

Variable annuities

  • Selling variable life and variable annuities requires a life license plus FINRA registration. There is no separate state exam.

Common exam traps

  • Best interest, not suitability. Its four obligations are care, disclosure, conflict of interest and documentation.
  • Training: a one-time 4 hours.
  • Free look: 10 / 20 / 45 days. There is no special 30-day senior rule.
  • Guaranty limit: $250,000, less than the $300,000 life death benefit limit.
