What it does
CA 23 45 excludes coverage for covered autos while used for public or livery passenger conveyance or for on-demand delivery services, the exposures created by transportation network company (rideshare) and app-based delivery platforms. Its first edition is 11 16; the current multistate edition is 11 20. CA 23 44 is the companion version that excludes only public or livery passenger conveyance, and CA 26 04 brings the same exclusion to single interest physical damage policies.
Who sees it
Insurers attach it broadly. The Massachusetts residual market, for example, attaches CA 23 45 "to all policies, except those policies providing coverage for public automobiles." Several states have their own versions (Texas, New Jersey, West Virginia, Virginia and Missouri).
Selling notes
- Ask whether any employee or owner drives for Uber, Lyft, DoorDash or similar platforms in a vehicle on the policy, and whether company vehicles are ever used that way.
- Businesses intentionally doing paid passenger transport need a public auto program instead; delivery businesses need a policy that does not carry this exclusion or that buys the exposure back.
