What it does
MM 99 39 provides loss of use or rental reimbursement coverage on Massachusetts commercial auto policies, paying for a substitute vehicle while a covered auto is out of service after a covered physical damage loss. CAR's Rule 33 directs: "Use Loss of Use/Rental Reimbursement Coverage Endorsement MM 99 39."
Key provisions
- CAR does not allow rental reimbursement to be written "for less than 30 days or for a limit of less than $15 per vehicle per day."
- Premium is developed from the Rate Section.
The current edition is 10 13. The multistate equivalent is CA 99 23.
Who needs it
Massachusetts businesses that need a replacement vehicle to keep operating when a truck or van is in the body shop.
Quoting notes
Set the daily limit at the real cost of renting a comparable commercial vehicle and the duration at typical repair times; the minimums are rarely enough for trucks.
