What it does

CA 05 35 excludes coverage for covered autos while made available through a vehicle sharing program, meaning an online application or digital network that connects owners of vehicles with others who want to rent them. ISO introduced it in its 2026 multistate forms revision (CA-2026-OFR26), approved for policies effective on or after September 1, 2027 in states that have adopted the revision. A companion version, CA 05 36, provides an exception for scheduled autos the insurer agrees to cover, and states have their own versions (for example North Dakota and Michigan).

Who sees it

Any commercial auto account once the insurer adopts it. Massachusetts already applies a similar residual-market exclusion to all policies (CR 99 05).

Selling notes

  • Ask whether any company vehicles are listed on Turo, Getaround or similar platforms.
  • Businesses that intend to share vehicles need the platform's coverage or an insurer willing to schedule those autos under CA 05 36.
  • Rideshare and on-demand delivery use is addressed separately by CA 23 44 and CA 23 45.
