What it does
MM 00 97 is the business auto declarations form used in Massachusetts in place of the multistate CA DS 03 for risks subject to the state's compulsory auto insurance law. The Commonwealth Automobile Reinsurers (CAR) manual lists it as part of both the Business Auto Coverage package and the Truckers/Motor Carrier Coverage package (CA 00 01, MM 00 97, IL 00 17, IL 00 21, CA 23 86, and CA 23 30 for motor carriers). The current edition is 07 25.
Key points
- Insurers may use their own declarations pages if they do not substantially differ from the form CAR adopted.
- In the CAR residual market, coverage on business auto policies is restricted to vehicles specifically described on the declarations and designated with covered auto symbols 7, 8 or 9 only.
- Risks not subject to the compulsory law (for example, autos registered elsewhere) use the multistate CA DS 03 along with MM 99 35 and MM 99 67.

Massachusetts compulsory coverages (bodily injury to others, personal injury protection, property damage liability and uninsured motorists) are provided through the Massachusetts Mandatory Endorsement MM 99 11; make sure the declarations show those coverages and limits along with optional coverages. For auto dealers, use MM 25 02.
